Colorado House Bill 10-1190

In February, the Colorado legislature passed and Governor Bill Ritter signed into law House Bill 10-1190.  This legislation repeals the 2.9% state sales tax exemption for electricity used in commercial applications.  Therefore, sales tax will apply to these accounts from March 1, 2010 through June 30, 2012.  A hearing was held on June 1, 2010 by the Colorado Department of Revenue.  The DOR is awaiting sign off from the Attorney General's Office before finalizing the rule.

Colorado Department of Revenue staff have indicated that if a consumer believes that they should not be charged sales tax, the consumer should file a form DR 1666 (04/01) with their electric utility - in this case, Morgan County REA.  MCREA will then be released from the obligation to collect sales tax.  However, if the Department of Revenue determines that the consumer is liable for sales tax, that consumer will be subject to back taxes and possible penalties.
